These Terms of Service (“Terms”) govern your use of the websites, apps, software, APIs and services provided by Bitping Pte. Ltd. (“Bitping”, “we”, “our” or “us”), including network measurement, bandwidth sharing, the p2proxy app and command-line tool, and the Bitping node software (together, the “Services”). By creating an account or using the Services you agree to these Terms and to our Privacy Policy. If you use the Services for an organisation, you accept these Terms on its behalf.
You must be at least 18 years old, or the age of majority where you live, and legally able to enter into these Terms. You must not use the Services if you are barred from doing so under applicable law. You confirm that you are not located in, or ordinarily resident in, a country or region subject to comprehensive sanctions or embargoes by Singapore, the United Nations, the United States, the European Union or the United Kingdom, and that you are not named on any of their sanctions or restricted-party lists.
Keep your account details accurate and your credentials, API keys and devices secure. You are responsible for everything done through your account. Tell us promptly at [email protected] if you think your account has been compromised.
The Services run on a network of nodes operated by independent third parties (“Node Operators”). Node availability, location, speed and network type vary and are outside our full control, so we do not guarantee that a particular node, location or level of performance will be available at any time. We may change, add or remove features, and some features may be offered only in certain regions or apps.
Paid Services are offered on the plans and prices shown on our website or dashboard when you subscribe. Subscriptions renew automatically until cancelled, and usage beyond your plan’s allowance is charged at the published rate. You authorise us and our payment processor to charge your payment method for all fees and applicable taxes. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then. We will give you reasonable advance notice of any price change, and you may cancel before it takes effect.
Because we pay Node Operators for the work done for you as it happens, fees already paid are non-refundable, except where required by law or where we have charged you in error. If the Services fall materially short of what we committed to, we may, at our discretion, provide service credits. Nothing in this section affects rights you have under consumer protection laws that cannot be excluded by contract.
We may apply usage limits, rate limits or extra checks (including identity or business verification) to protect the network, particularly for new accounts or high volumes. We may refuse or limit service where we reasonably suspect fraud or abuse.
If you download one of our apps from Apple’s App Store, you also agree to Apple’s Licensed Application End User License Agreement. These Terms are between you and Bitping, not Apple; Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Paid access to the Services is purchased through our website, not in the app. Bitping, not Apple, is responsible for the app and its content, for addressing any claims relating to it (including product liability, legal or regulatory compliance and intellectual property infringement claims), and for any warranties that cannot be excluded by law. If the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
You are responsible for all traffic, requests and jobs sent through your account, and you must use the Services only for lawful purposes. You must not use the Services to:
Node Operators’ internet connections carry your traffic, so we take abuse seriously. Report suspected abuse to [email protected].
By running the Bitping node software you allow the network to use your device and internet connection to carry out measurement jobs and, if you enable it, to carry other users’ traffic. You are responsible for having the right to share your connection, including under your internet provider’s terms and your local laws, and for any costs this causes. You can choose which features your node takes part in and stop at any time by turning them off or uninstalling the software.
You must not tamper with the node software, misreport your node’s location, capacity or work, run nodes on devices you do not own or are not authorised to use, or otherwise try to obtain earnings you have not genuinely earned.
The node software applies safety controls to the traffic it carries and lets you block destinations you don’t allow. We act against customers who abuse the network as described in section 6, but we cannot review every connection. Questions or concerns about traffic seen on your node can be sent to [email protected].
Earnings are calculated by us from the work your node verifiably performs, under the rates and rules shown in the app or dashboard, which may change. Our calculation is final, except for clear errors, which you may raise with us within 60 days. We may withhold or reverse earnings that were not genuinely earned, such as earnings obtained through fraud, abuse, manipulation or a breach of these Terms. Earnings that remain unclaimed for more than 12 months may be forfeited, after we have given you at least 30 days’ notice by email to claim them. Payouts are made in cryptocurrency to the wallet address you provide. Blockchain transfers cannot be reversed, so check your address carefully: we are not responsible for payouts sent to an address you gave us. The value of cryptocurrency can change. You are responsible for any taxes on your earnings.
We may investigate suspected breaches of these Terms. Where we reasonably believe a breach has occurred, we may limit, suspend or close accounts, block devices or nodes, cancel subscriptions, and withhold or reverse earnings or credits obtained through the breach. We will normally tell you first and give you a chance to respond, unless doing so would risk harm to others, compromise an investigation or breach the law. We may preserve records and cooperate with law enforcement and other authorities where the law requires or where we believe it is necessary to protect our users, Node Operators or the public.
The Services, software and content we provide are owned by Bitping or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use them for their intended purpose. Open-source components are licensed under their own terms. You keep ownership of the data you submit; you grant us the rights we need to process it to provide the Services. If you send us feedback, we may use it freely.
We welcome reports of security vulnerabilities at [email protected]. Please give us reasonable time to fix an issue before disclosing it, and do not access other users’ data, degrade the Services or test against nodes you do not operate. We may offer a reward for valid reports at our discretion.
The Services may rely on or link to third-party services, such as payment processors, sign-in providers and app stores. Their own terms apply to your use of them, and we are not responsible for them.
The Services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement, and we do not guarantee that the Services will be uninterrupted, error-free or suited to any particular use. The Services are not designed to provide anonymity, and you should not rely on them where failure could cause physical harm or serious loss.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the Unfair Contract Terms Act 1977 of Singapore. Subject to that, and to the fullest extent the law allows, Bitping and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the Services is limited to the greater of the amounts you paid us in the 12 months before the claim arose and USD 100.
You will indemnify Bitping and its officers, employees and partners against third-party claims, and the resulting losses and costs (including reasonable legal fees), to the extent they arise from your content or traffic, your breach of these Terms, or your breach of the law. This does not apply to the extent a claim results from our own breach or negligence.
You can stop using the Services and delete your account at any time from Settings on app.bitping.com. We may end or suspend your access as described in section 6, or with reasonable notice if we stop offering a Service. Sections that by their nature should survive termination — including payment obligations, intellectual property, disclaimers, limitation of liability, indemnity and governing law — will survive.
We may update these Terms from time to time. If the changes are significant we will tell you at least 14 days in advance, for example by email or a notice in the dashboard, unless a change is needed sooner for legal or security reasons. If you don’t agree, you can stop using the Services and cancel before the change takes effect; continuing to use the Services afterwards means you accept the updated Terms.
These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute, except where the law of your country gives you the right to bring proceedings where you live.
These Terms and the policies they refer to are the whole agreement between you and Bitping about the Services. If any part is found unenforceable, it will be enforced to the extent possible and the rest still applies. Our not enforcing a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a reorganisation, merger or sale.
We are not liable for delays or failures caused by events beyond our reasonable control, such as outages of internet or hosting providers, actions of Node Operators’ networks, natural disasters or government action.
We may send you notices by email to your account address or through the Services, and you agree that notices and agreements made electronically satisfy any requirement for them to be in writing.
Except for Apple and its subsidiaries (section 3.4) and the persons protected by sections 11 and 12, no one other than you and Bitping has any right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of these Terms.
